DUNNES STORES IN WEXFORD TOWN ORDERED TO PAY DAMAGES FOLLOWING COURT CASE
The High Court has ordered a Wexford Town supermarket to pay damages of 70-thousand euro.
It follows a case taken by a customer who was on crutches and slipped on a wet floor.
Graham Murphy from Bishospwater in County Wexford sued Dunnes Stores in Redmond Square in Wexford Town after he fell on January 26th 2012 alleging it negligently caused him to slip on a liquid spill.
Mr Murphy who’s in his 40s was recovering from complex hip surgery at the time.
Dunnes had pleaded that he did not slip on water but instead tripped on a pad underneath a freezer.
But Ms Justice O’Hanlon, having viewed CCTV footage of the accident, said it was “beyond doubt” Mr Murphy lost his balance when his crutch gave way on the wet and slippery floor surface.
The judge found the normal system which should have been in operation in the store to prevent spillages was not followed.
She refused to grant a stay on any payment out pending a Supreme Court appeal and directed Dunnes to pay out €30,000 pending appeal.
